General conditions of seasonal rental

These general conditions of sale govern the rental of furnished tourist accommodation “La Source”, located at 10 route de la Cassotte in Cherves-Richemont, accessible to individuals and businesses via the website www.location-saisonniere-cognac.fr, and are intended to define the rights and obligations of the owner and the tenant.

 

They are an integral part of the seasonal rental contract that binds the owner and the tenant.

 

Article 1 – Object of the contract

 

The purpose of these general conditions of sale is to set the contractual provisions between:

and the tenant, whose full contact details must be provided when booking online.

 

The reservation of furnished accommodation through this site implies unreserved acceptance by the tenant of these general conditions of sale.

 

Article 2 – Duration of stay

 

This accommodation is rented to you for a period defined during your reservation, determined in your rental contract. Under no circumstances may a traveler claim any right to remain in the premises outside this period.

 

  • Arrival between 3 p.m. and 9 p.m. Luggage storage is possible from 9am.

  • Departure no later than 11 a.m.

 

Article 3 – Persons accommodated

 

The accommodation that is the subject of this rental must not, under any circumstances, be occupied by a number of people greater than that indicated when booking, except with the prior agreement of the owner or his representative. If necessary, the owner or his representative may claim additional rent, or refuse entry to the premises.

 

Parties and gatherings of all kinds are strictly prohibited.

 

During the day :

 

  • Exceptionally and with the owner's authorization, the number of people present in the accommodation can be extended to a maximum of 6 people (including children).

For the night :

 

  • Beyond 2 travelers, additional travelers are subject to an additional charge of €10 per person and per night;

  • If 2 travelers wish to sleep separately (in the bed and the sofa bed), an additional charge of €10 per stay will be applied;

  • In all cases, the accommodation capacity is limited to 4 people.

 

Article 4 – Rent and charges

 

The amount of the rent and charges (water, electricity, wi-fi) is indicated on the “Our prices” page. A 50% deposit is required upon booking, the balance to be paid no later than the day of entry into the accommodation.

 

Article 5 – Reservation

 

The reservation will only be validated upon receipt of the deposit.

 

Article 6 – Cancellation

 

Cancellation by the tenant

 

In case of cancellation of the reservation by the tenant up to 7 days before arrival,

  • with a compelling reason, the deposit will be fully refunded;

  • without a compelling reason, the deposit will remain due.

 

Less than 7 days before arrival, no refund will be made.

 

Article 7 – Security deposit

 

When entering the accommodation, a security deposit and a cleaning deposit will be requested (in cash or by check).

 

  • Amount of the security deposit: 500 €

  • Amount of the cleaning deposit: 50 €

 

The security deposit, non-bearing of interest, cannot in any way be allocated to the payment of the rent or considered as such. It is used to respond to damage that may be caused to objects furnishing the rented premises.

 

In the absence of rental repairs made necessary by the tenant, the return of the security deposit will be made within 8 days. Otherwise, the refund of the security deposit will be made within 60 days, after deducting the sums due by the tenant for rental repairs. If the sum thus paid proves to be insufficient, the tenant will pay any additional sum on presentation of supporting documents by the owner and this within 30 days.

 

The owner, for his part, undertakes to justify the amount necessary for the restoration of the accommodation. In the event of non-amicable settlement, an expertise will be made and the court will be seized. It is the District Court of the place of rental that is competent.

 

Cancellation by owner

 

Cancellation made within 48 hours of booking

Given that the accommodation is offered for rent on other holiday rental sites, and in order to avoid double bookings, the owner reserves the right to cancel the reservation within 48 hours of the order, by proceeding to a full refund of the sums paid, without compensation or indemnity, or by offering other dates of stay.

 

Cancellation made after 48 hours

If the reservation is canceled by the owner after 48 hours, the latter has an obligation, under article 1590 of the Civil Code, to return double the deposit to the tenant. All other sums paid will be fully refunded, without compensation or indemnity.

 

Article 8 – Insurance

 

The tenant must be insured against rental risks, theft, fire, water damage and recourse by neighbors and have the furniture rented out insured (either through his own insurance contract covering the risks of seasonal rental, or by subscribing to a special insurance policy for the entire duration of the rental).

 

In addition, the owner has taken out home insurance for the accommodation with the company Apivia (Macif group).

 

Article 9 – Obligations of the tenant

 

  • The tenant will peacefully use the rented accommodation and the furniture and equipment according to the destination given to them by the lease and will be liable for any damage and losses that may occur during the term of the contract in the premises of which he has exclusive use.

  • The tenant will maintain the rented accommodation and return it in a good state of cleanliness and rental repairs at the end of the contract. If items in the inventory are broken or damaged, the owner may claim their replacement value.

  • The tenant must avoid any noise likely to disturb the neighbours, in particular between 10 p.m. and 8 a.m.

  • The tenant will not be able to exercise any recourse against the owner in the event of theft and depredations in the rented premises.

  • The tenant will respect the maximum number of people who can enter the premises, in accordance with the description given to him.

  • The tenant cannot oppose the visit of the premises if the owner or his agent so requests.

  • In the absence of restitution of the accommodation in a perfect state of cleanliness, the tenant undertakes to pay for the cleaning that the owner will be forced to carry out. (Note: the tenant may be offered to take out a cleaning package upon departure.)

 

Article 10 – Automatic termination

 

In the event of breach by the tenant of one of the contractual obligations, this lease will be terminated automatically. This termination will take effect after a period of 48 hours after a simple summons by registered letter or letter delivered by hand remained unsuccessful.

 

Article 11 – Election of domicile

 

For the execution of the present, the owner and the tenant elect domicile in their respective domicile (or registered office). However, in the event of a dispute, the court of the owner's domicile will have sole jurisdiction. This contract and its consequences are subject to French law.
